Lecture #5 An Overview of Water Pollution Criminal Laws From a Uniquely Texas Perspective

Speaker:  Neil Kucera – Hays County Environmental Enforcement Unit.Assistant District Attorney –Hays County District Attorney’s Office Bio: Neil Kucera is an Assistant District Attorney in the Hays County District Attorney’s Office.  He also teaches Environmental Law, Criminal Law and several other classes as an adjunct professor at Texas State University.
Synopsis: This presentation involves a brief history of the Clean Water Act and how it operates under the Federalist system used in the United States.  We will look at the specific elements of water pollution enforcement in Texas (known as Unauthorized Discharge), as they are found in Chapter 7 of the Texas Water Code.  Special emphasis will be given to the broad definition of “Water in the State”, and how it differs from the Federal definition of “Navigable Waters”.
